BOARD OF EDUCATION
ALTON COMMUNITY UNIT SCHOOL DISTRICT NO. 11
Special Meeting of December 12, 2006
5:00 P.M.

The following Board of Education members were present: Benjamin Golley Michael Harris, Vivian Monckton, Dan Nickel and David P. Lauschke. Others who were present were: David Elson, Superintendent of Schools; Donald Lindsey, Assistant Superintendent for Elementary Education; Mark Cappel, Hearing Officer; Philip Trapani, Assistant Superintendent for Secondary Education/Principal; Cindy Schuenke, Alton Middle School Assistant Principal; Henrietta Young, Principal. The parents and student (#110044) attended the hearing with their Attorney, Amy Meyer.

Board Secretary Vivian Monckton read the notice of the hearing.

Motion: Closed Session:
It was moved by Mr. Harris, seconded by Ms. Monckton, that the Board of Education conduct a closed session for the purpose of hearing a student disciplinary matter. Voting on the motion was as follows: Harris-yea; Monckton-yea; Golley-yea; Nickel-yea; Lauschke-yea. Nay-none.

Motion: Open Session:
It was moved by Mr. Nickel, seconded by Mr. Harris, that the Board of Education reconvene to an open session. Voting on the motion was as follows: Nickel-yea; Harris-yea; Golley-yea; Monckton-yea; Lauschke-yea. Nay-none.

Motion: Resolution:
It was moved by Mr. Harris, seconded by Mr. Nickel, that the Board of Education, after considering the report of Mr. Mark Cappel, Hearing Officer, and the evidence, finds that the following activities of student #110044 constitute gross disobedience and gross misconduct:
1. Disorderly Conduct.
2. Physical Aggression.
3. Engaging in activity that constitutes an interference with school purposes and educational function.
Voting on the motion was as follows: Harris-yea; Nickel-yea; Golley-yea; Monckton-yea; Lauschke-yea. Nay-none.

Motion: Closed Session:
It was moved by Mr. Harris, seconded by Mr. Nickel that the Board of Education conduct a closed session for the purpose of hearing the record of attendance, grades and discipline of student #110044. Voting on the motion was as follows: Harris-yea; Nickel-yea; Golley-yea; Monckton-yea; Lauschke-yea. Nay-none.

Motion: Open Session:
It was moved by Mr. Harris, seconded by Ms. Monckton, that the Board of Education reconvene to an open session. Voting on the motion was as follows: Harris-yea; Monckton-yea; Golley-yea; Nickel-yea; Lauschke-yea. Nay-none.

Motion: Resolution:
It was moved by Mr. Harris, seconded by Ms. Monckton, that the Board of Education, after considering evidence and mitigation witnesses, finds as follows:
A. That student #110044 is responsible for the following activities:
1. Entering into an existing fight.
2. Engaging in activity that constitutes an interference with school purposes.
B. That said conduct is a violation of student discipline policy and school district discipline rules and constitutes gross disobedience and gross misconduct.
C. That notice of this expulsion hearing has been given as required by Statute.
D. That the records and testimony reveal no evidence of special education on the part of student #110044.

WHEREFORE, BE IT RESOLVED, that because of the aforementioned findings of fact and other evidence heard, the Board of Education hereby expels student #110044 from school thru the end of the 2007-2008 school year with the possibility for Principal’s Probation beginning 2nd semester of the 2007-2008 school year. Said expulsion is to be effective immediately and further prohibits said student #110044 from attending any school sponsored events during the aforementioned period of time. Voting on the motion was as follows: Harris-yea; Monckton-yea; Golley-yea; Nickel-yea; Lauschke-yea. Nay-none.

The meeting continued with the next hearing.

It was the recommendation of Superintendent Elson that student #110044 be expelled for thru the 2007-2008 school year with the possibility of Principal’s Probation beginning the 2nd semester of the 2007-2008 school year.

During an executive session, the Board of Education determined the punishment for student #110044.

While in an open session, the Board of Education took action and expelled student #110044 from school thru the end of the 2007-2008 school year with an opportunity for Principal’s Probation beginning 2nd semester of 2007-2008.
